1. Acceptance of Terms
These Terms and Conditions (“Terms”) govern your use of Go Casual’s website at gocasual.co.nz and the web application at app.gocasual.co.nz (collectively, the “Services”).
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Services.
Go Casual is operated by Revibe Digital, a business based in New Zealand.
2. Description of Services
Go Casual provides cloud-based payroll management software designed for New Zealand sole traders and businesses hiring casual employees. Our Services may include:
- Payroll processing and calculations
- PAYE, ACC, and KiwiSaver calculations
- Payslip generation and distribution
- Employment contract templates
- Timesheet management
- IRD reporting tools
- Document storage
- Employee portal access
Features may change from time to time and may vary depending on the plan you select.
3. Not Associated with IRD or Government Agencies
We provide software tools to assist with payroll administration, but we are not a government authority and do not provide official IRD services.
4. Disclaimer of Liability for Payroll Calculations
4.1 No Guarantee of Accuracy
While Go Casual uses publicly available information and internal logic to assist with payroll calculations, we make no warranties or guarantees regarding the accuracy, completeness, or correctness of:
- PAYE tax calculations
- ACC levy calculations
- KiwiSaver contribution calculations
- Student loan deduction calculations
- Holiday pay calculations
- Any other payroll-related calculations
4.2 Your Responsibility
You are solely responsible for:
- Verifying all payroll calculations before processing payments
- Ensuring compliance with all New Zealand employment laws and IRD requirements
- Filing correct tax returns and employer information with IRD
- Paying the correct amounts to employees and government agencies
- Maintaining accurate employment and payroll records
- Seeking professional accounting or legal advice where required
4.3 No Liability for Errors
Go Casual, Revibe Digital, and their affiliates shall not be liable for:
- Incorrect payroll calculations or tax deductions
- Penalties, interest, or fines imposed by IRD or other authorities
- Employment disputes arising from payroll errors
- Financial losses resulting from incorrect calculations
- Missed deadlines for filing, reporting, or payments
- Any other damages, whether direct, indirect, incidental, special, or consequential
4.4 Information Currency
We aim to keep rates, thresholds, and calculation logic reasonably current based on publicly available information. However:
- Tax rates, legislation, and payroll rules may change without notice
- We may not immediately update the Services when changes occur
- You are responsible for checking that current rates and settings are correct
- You should refer to official IRD and Employment New Zealand resources where needed
5. User Accounts and Security
5.1 Account Registration
To use Go Casual, you must create an account and provide accurate information. You agree to:
- Provide truthful, current, and complete information
- Keep your account information up to date
- Maintain the confidentiality of your password and login details
- Notify us promptly of any unauthorised access or suspected security issue
5.2 Account Security
You are responsible for all activity that occurs under your account. We recommend:
- Using a strong, unique password
- Not sharing login credentials
- Logging out after use on shared devices
- Using any additional security features we make available
5.3 Account Suspension
We may suspend, restrict, or terminate your account if you:
- Violate these Terms
- Provide false or misleading information
- Engage in fraudulent, abusive, or unlawful activity
- Fail to pay applicable fees
- Use the Services in a manner that harms other users, the platform, or our business
6. Subscription and Payment
6.1 Pricing Plans
Go Casual offers pricing plans as described on our website or within the application from time to time. Prices are in New Zealand Dollars (NZD) and exclude GST unless stated otherwise.
6.2 Free Plan
- The Free Plan is subject to the features, limits, and usage rules displayed on our website or within the application from time to time.
- We may change, limit, suspend, or discontinue the Free Plan, or any feature of it, at any time.
- No credit card is required for the Free Plan unless stated otherwise at the time of signup or upgrade.
6.3 Paid Plans
- Paid plans are billed monthly or annually in advance, depending on the plan selected.
- Fees are non-refundable except as required by law or as expressly stated in these Terms.
- Prices may change with at least 30 days’ notice.
- You may cancel your subscription at any time, and cancellation will take effect at the end of your current billing period unless stated otherwise.
- Plans may include feature limits, usage limits, employee limits, fair use limits, or other plan conditions as described on our website, within the application, or in these Terms.
6.4 Enterprise Plan Fair Use
The Enterprise Plan is subject to fair use and is intended for standard commercial use patterns only. It is not intended to automatically cover unusually high-volume payroll operations, very large workforces, frequent or repeated payroll processing at scale, excessive support demands, bulk onboarding at scale, or other usage that places disproportionate load on the Services.
Fair use is assessed by Go Casual acting reasonably, taking into account matters such as employee volume, payroll frequency, processing load, storage use, onboarding requirements, support requirements, bulk imports or exports, and other usage patterns materially outside the normal intended use of the plan.
If your use exceeds fair use, we may, acting reasonably:
- contact you to discuss your usage and suitable pricing options;
- require you to move to a custom-priced plan, usage-based plan, or separately negotiated agreement;
- apply agreed additional charges for excess usage where applicable;
- place reasonable technical limits on the account to protect the Services; or
- suspend or restrict access where excessive usage continues without an agreed commercial arrangement.
We will make reasonable efforts to provide notice before taking action under this clause, except where immediate action is reasonably necessary to protect the Services, other users, or our business operations.
6.5 Payment Processing
Payments are processed by third-party payment providers such as Stripe. By providing payment information, you authorise us to charge the applicable fees to your selected payment method.
6.6 Failed Payments
If a payment fails:
- we may retry the payment;
- your account or access to paid features may be suspended until payment is received; and
- you remain responsible for any outstanding amounts owing.
7. Cancellation and Refunds
7.1 Cancellation
You may cancel your subscription at any time through your account settings or by contacting [email protected].
- Cancellation takes effect at the end of your current billing period unless we state otherwise.
- You will usually retain access until the end of the paid period.
- No refunds are provided for partial months, partial years, or unused time unless required by law.
7.2 Customer Responsibility Before Cancellation
- You are solely responsible for exporting, downloading, and retaining copies of your payroll records, employee records, documents, reports, and any other data you require before cancellation or account closure.
- You must ensure you have kept all records required by law before your account ends.
- We are not responsible for storing, archiving, or supplying your records to you after your access ends, except where required by law.
7.3 Refund Policy
Subscription fees are generally non-refundable. However, we may provide a refund, credit, or adjustment at our discretion in cases such as:
- billing errors or duplicate charges
- prolonged service outages materially preventing use of the Services
- other exceptional circumstances we consider appropriate
Refund requests must be submitted to [email protected] within 30 days of the relevant charge.
8. Intellectual Property
8.1 Our Intellectual Property
All content, features, and functionality of Go Casual, including but not limited to:
- software code and algorithms
- design, layout, and user interface
- text, graphics, logos, and images
- calculation methodologies
- contract templates and generated documents
are owned by Revibe Digital or its licensors and are protected by copyright, trademark, and other intellectual property laws.
8.2 Your Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your internal business purposes only. You may not:
- copy, modify, or create derivative works from the Services
- reverse engineer, decompile, or attempt to extract source code
- resell, sublicense, or redistribute the Services
- remove copyright notices, branding, or proprietary notices
- use the Services to build or support a competing product or service
8.3 Your Data
Subject to these Terms, you retain your rights in the data you input into Go Casual. We do not claim ownership of your employee information, payroll data, or uploaded business documents.
9. Acceptable Use Policy
You agree not to use the Services to:
- violate any law, regulation, or legal obligation
- infringe another person’s intellectual property or privacy rights
- upload, transmit, or distribute malware, viruses, or harmful code
- attempt to gain unauthorised access to systems, accounts, or data
- interfere with, disrupt, or degrade the operation of the Services
- harass, abuse, threaten, or harm others
- impersonate another person or entity
- collect or store personal data about others without proper authority
- use bots, scraping tools, or automated systems without our prior written permission
10. Limitation of Liability
10.1 Services Provided “As Is”
The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, or error-free operation.
10.2 Maximum Liability
To the maximum extent permitted by law, Go Casual and Revibe Digital shall not be liable for:
- any indirect, incidental, special, exemplary, consequential, or punitive damages
- loss of profits, revenue, savings, business opportunities, goodwill, or data
- IRD penalties, fines, or interest charges
- employment disputes or claims involving your employees or contractors
- errors in payroll calculations, deductions, or payments
- service interruption, downtime, unavailability, or data loss
- acts, omissions, or failures of third parties
To the maximum extent permitted by law, our total aggregate liability to you for any claim arising from or relating to the Services or these Terms shall not exceed the total amount paid by you to us for the Services in the 12 months immediately preceding the event giving rise to the claim.
10.3 New Zealand Law
Nothing in these Terms limits any rights you may have under law that cannot lawfully be excluded or limited. Where liability cannot be excluded, it is limited to the maximum extent permitted by law.
11. Your Responsibilities as an Employer
When using Go Casual, you acknowledge and agree that:

- you are the legal employer of the employees or workers you manage in Go Casual
- you are responsible for all employment law, payroll, and tax compliance
- you must comply with the Employment Relations Act 2000, Holidays Act 2003, Tax Administration Act 1994, and all other applicable New Zealand laws and obligations
- Go Casual is a software tool only and is not your employer, accountant, tax agent, payroll bureau, or legal advisor
11.2 Verification Required
You must independently verify:
- all payroll calculations before paying employees
- tax rates, settings, and thresholds are current and correct
- IRD deductions and reporting match your obligations
- employment agreements and practices comply with New Zealand law
- holiday pay and leave balances are accurate
- all data entered into the system is correct and complete
11.3 Professional Advice
You should seek professional advice from qualified accountants, payroll specialists, tax advisors, or employment lawyers for:
- complex payroll situations
- tax compliance questions
- employment law matters
- IRD audits or investigations
- dispute resolution or disciplinary matters
11.4 Data Accuracy and Retention
You are responsible for:
- entering accurate employee and business information
- using correct tax codes, pay rates, and settings
- inputting accurate hours, leave, and payments
- keeping employee records up to date
- maintaining your own copies and backups of records you are legally required to keep
- exporting and retaining records before cancellation, suspension, or closure of your account
12. Service Availability and Modifications
12.1 Service Availability
We aim to provide a reliable service, but we do not guarantee that:
- the Services will be available 24/7 without interruption
- the Services will be error-free, bug-free, or uninterrupted
- defects will be corrected within any specific timeframe
- the Services will meet all of your requirements or expectations
12.2 Maintenance and Downtime
- we may perform scheduled maintenance that temporarily interrupts service
- we will try to provide notice of planned maintenance where practical
- emergency maintenance may occur without notice
- unless required by law, no refund or credit is payable for downtime, maintenance, or interruption
12.3 Service Modifications
We may at any time:
- modify, suspend, or discontinue any feature or part of the Services
- update the Services without notice
- change pricing with at least 30 days’ notice
- add, remove, or modify integrations with third-party services
13. Data Ownership, Access, and Deletion
13.1 Your Data
You retain ownership of the data you input into Go Casual. We claim no ownership rights in your employee information, payroll records, business information, or uploaded documents.
13.2 Access During an Active Account
While your account is active and in good standing, the Services may allow you to access, view, and export certain data and records made available within the application.
13.3 Your Responsibility to Export and Retain Records
- You are solely responsible for exporting, downloading, backing up, and retaining all records, reports, documents, and payroll information you require.
- You must keep your own copies of records required for legal, tax, employment, audit, or business purposes.
- The availability of export tools within the Services does not shift responsibility for record retention to us.
13.4 After Cancellation, Non-Payment, or Closure
- After cancellation, account closure, prolonged inactivity, or non-payment, your access to the Services and your data may be suspended or terminated.
- We are not responsible for maintaining your data for your future access once your account is no longer active, except where required by law.
- We may delete data from active systems after cancellation, closure, or non-payment without further notice.
- You must export any required records before your account ends or access is lost.
13.5 Limited Retention
Despite the above, we may retain limited copies of data for a reasonable period in backups, logs, security systems, or internal records where necessary for operational, security, fraud prevention, dispute resolution, legal, regulatory, or compliance purposes. Any such retention does not create an obligation for us to restore, maintain, or provide that data back to you after your account has ended.
14. Indemnification
You agree to indemnify, defend, and hold harmless Go Casual, Revibe Digital, and their officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising out of or relating to:
- your use of the Services
- your breach of these Terms
- your breach of any applicable law or regulation
- employment disputes with your employees or contractors
- IRD audits, penalties, or fines
- incorrect payroll calculations, payments, deductions, or filings
- any data, content, or documents you provide or upload to the Services
15. Privacy, Security, and Confidentiality
We take reasonable steps to protect information processed through the Services. However, you acknowledge that:
- no system is completely secure or immune from breach, failure, or unauthorised access
- you should only store information reasonably necessary for your use of the Services
- you remain responsible for your own internal security practices and access controls
- we may disclose information where required by law, court order, or lawful government request
Our collection and handling of personal information is also governed by our Privacy Policy.
16. Third-Party Services and Integrations
Go Casual may integrate with or rely on third-party services. We are not responsible for:
- the availability, reliability, or functionality of third-party services
- the privacy or security practices of third-party providers
- changes to, interruptions of, or discontinuation of third-party services
- errors, delays, or issues caused by third-party systems
Your use of any third-party service is governed by that provider’s own terms and privacy practices.
17. User Content and Conduct
17.1 User Content
You are solely responsible for any content you upload or submit through the Services, including:
- employment agreements and documents
- employee information and identification records
- company branding, logos, and templates
- notes, comments, and internal records
17.2 Prohibited Content
You must not upload, submit, or store content that:
- violates any law or legal obligation
- infringes intellectual property, confidentiality, or privacy rights
- contains malware, scripts, or harmful code
- is obscene, abusive, discriminatory, or unlawful
- you are not authorised to collect, process, or use
18. Governing Law and Dispute Resolution
18.1 Governing Law
These Terms are governed by the laws of New Zealand, and the courts of New Zealand have exclusive jurisdiction over any dispute arising out of or in connection with the Services or these Terms.
18.2 Dispute Resolution
Before starting court proceedings, you agree to:
- contact us at [email protected] with details of the issue;
- provide a clear written description of the dispute; and
- allow us 30 days to attempt to resolve the matter in good faith.
19. Updates to Terms
We may update these Terms from time to time. We may notify you of material changes by:
- posting the updated Terms on this page
- sending an email to your registered address
- displaying a notice in the application
Your continued use of the Services after the updated Terms take effect constitutes your acceptance of the revised Terms.
20. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.
21. Entire Agreement
These Terms, together with our Privacy Policy and any plan-specific terms we publish, form the entire agreement between you and Go Casual regarding the Services and replace any prior understandings or agreements relating to them.
