1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern your use of Go Casual’s website at gocasual.co.nz and the web application at app.gocasual.co.nz (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Services.

Go Casual is operated by Revibe Digital, a business based in New Zealand.

2. Description of Services

Go Casual provides cloud-based payroll management software designed for New Zealand sole traders and small businesses hiring casual employees. Our Services include:

  • Payroll processing and calculations
  • PAYE, ACC, and KiwiSaver calculations
  • Payslip generation and distribution
  • Employment contract templates
  • Timesheet management
  • IRD reporting tools
  • Document storage
  • Employee portal access

3. Not Associated with IRD or Government Agencies

 

Important Disclaimer: Go Casual is NOT affiliated with, endorsed by, or associated with the Inland Revenue Department (IRD), Employment New Zealand, ACC, KiwiSaver, or any other New Zealand government agency. We are an independent software provider.

We provide software tools to assist with payroll management, but we are not a government authority and do not provide official IRD services.

4. Disclaimer of Liability for Payroll Calculations

 

Critical Disclaimer – Please Read Carefully:

4.1 No Guarantee of Accuracy

While Go Casual uses the most recent publicly available information from the IRD and Employment New Zealand to perform payroll calculations, we make NO WARRANTIES OR GUARANTEES regarding the accuracy, completeness, or correctness of:

  • PAYE tax calculations
  • ACC levy calculations
  • KiwiSaver contribution calculations
  • Student loan deduction calculations
  • Holiday pay calculations
  • Any other payroll-related calculations

4.2 Your Responsibility

YOU ARE SOLELY RESPONSIBLE for:

  • Verifying all payroll calculations before processing payments
  • Ensuring compliance with all NZ employment laws and IRD requirements
  • Filing correct tax returns and employer schedules with IRD
  • Paying the correct amounts to employees and government agencies
  • Maintaining accurate employment records
  • Seeking professional accounting or legal advice when needed

4.3 No Liability for Errors

Go Casual, Revibe Digital, and their affiliates shall NOT be liable for:

  • Any incorrect payroll calculations or tax deductions
  • Penalties, interest, or fines imposed by IRD or other authorities
  • Employment disputes arising from payroll errors
  • Financial losses resulting from incorrect calculations
  • Missed deadlines for IRD filing or payments
  • Any other damages, whether direct, indirect, incidental, or consequential

4.4 Information Currency

We endeavor to keep our tax rates, thresholds, and calculation methods up-to-date based on publicly available IRD information. However:

  • Tax rates and legislation may change without notice
  • We may not immediately update our system when changes occur
  • You are responsible for verifying that current rates are being used
  • We recommend checking IRD’s official website for the latest rates

 

Professional Advice Recommended: Go Casual is a software tool, not a substitute for professional accounting or legal advice. We strongly recommend consulting with a qualified accountant or tax professional for complex payroll situations.

5. User Accounts and Security

5.1 Account Registration

To use Go Casual, you must create an account and provide accurate information. You agree to:

  • Provide truthful and complete information
  • Keep your account information up-to-date
  • Maintain the confidentiality of your password
  • Notify us immediately of any unauthorized access

5.2 Account Security

You are responsible for all activity that occurs under your account. We recommend:

  • Using a strong, unique password
  • Not sharing your login credentials
  • Logging out after each session on shared computers
  • Enabling two-factor authentication if available

5.3 Account Suspension

We reserve the right to suspend or terminate your account if you:

  • Violate these Terms
  • Provide false information
  • Engage in fraudulent activity
  • Fail to pay subscription fees
  • Use the Services in a manner that harms others or our business

6. Subscription and Payment

6.1 Pricing Plans

Go Casual offers multiple pricing plans as described on our website. Prices are in New Zealand Dollars (NZD) and exclude GST unless stated otherwise.

6.2 Free Plan

  • The Free Plan allows 1 employee maximum
  • We reserve the right to modify or discontinue the Free Plan at any time
  • No credit card required for the Free Plan

6.3 Paid Plans

  • Subscription fees are billed monthly or annually in advance
  • Fees are non-refundable except as required by law
  • Prices may change with 30 days’ notice
  • You can cancel your subscription at any time

6.4 Payment Processing

Payments are processed by third-party payment providers (e.g., Stripe). By providing payment information, you authorize us to charge the applicable fees to your payment method.

6.5 Failed Payments

If a payment fails:

  • We will attempt to retry the payment
  • Your account may be suspended until payment is received
  • You remain responsible for any outstanding amounts

7. Cancellation and Refunds

7.1 Cancellation

You can cancel your subscription at any time through your account settings or by contacting [email protected].

  • Cancellation takes effect at the end of your current billing period
  • You will retain access until the end of the paid period
  • No refunds for partial months or unused time

7.2 Refund Policy

Subscription fees are generally non-refundable. However, we may provide refunds at our discretion in cases of:

  • Billing errors or duplicate charges
  • Service outages preventing use for extended periods
  • Other exceptional circumstances

8. Intellectual Property

8.1 Our Intellectual Property

All content, features, and functionality of Go Casual, including but not limited to:

  • Software code and algorithms
  • Design, layout, and user interface
  • Text, graphics, logos, and images
  • Calculation methodologies
  • Contract templates

are owned by Revibe Digital and protected by copyright, trademark, and other intellectual property laws.

8.2 Your License

We grant you a limited, non-exclusive, non-transferable license to access and use the Services for your internal business purposes. You may not:

  • Copy, modify, or create derivative works
  • Reverse engineer or decompile the software
  • Resell or redistribute the Services
  • Remove copyright notices or branding
  • Use the Services to build a competing product

8.3 Your Data

You retain all ownership rights to the data you input into Go Casual (employee information, payroll data, etc.). We claim no ownership over your data.

9. Acceptable Use Policy

You agree NOT to use our Services to:

  • Violate any laws or regulations
  • Infringe on others’ intellectual property rights
  • Transmit malware, viruses, or harmful code
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Services
  • Harass, abuse, or harm others
  • Impersonate any person or entity
  • Collect or store personal data about other users without consent
  • Use automated systems (bots, scrapers) without permission

10. Limitation of Liability

10.1 Services Provided “AS IS”

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of calculations
  • Uninterrupted or error-free operation

10.2 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GO CASUAL AND REVIBE DIGITAL SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • IRD penalties, fines, or interest charges
  • Employment disputes or legal claims from employees
  • Errors in payroll calculations or tax deductions
  • Service downtime or data loss
  • Third-party actions or omissions

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

10.3 New Zealand Law

Some jurisdictions do not allow the limitation of certain warranties or liability. In such cases, our liability will be limited to the maximum extent permitted by law.

11. Your Responsibilities as an Employer

When using Go Casual, you acknowledge and agree that:

11.1 You Are the Employer

  • You are the legal employer of the employees you manage in Go Casual
  • You are responsible for all employment law compliance
  • You must comply with the Employment Relations Act 2000 and all NZ employment laws
  • Go Casual is a software tool only; we are not your employer, accountant, or legal advisor

11.2 Verification Required

You must independently verify:

  • All payroll calculations before paying employees
  • Tax rates and thresholds are current and correct
  • IRD deductions match your obligations
  • Employment contracts comply with NZ law
  • Holiday pay calculations are accurate
  • All data entered into the system is correct

11.3 Professional Advice

You should seek professional advice from qualified accountants, tax advisors, or employment lawyers for:

  • Complex payroll situations
  • Tax compliance questions
  • Employment law matters
  • IRD audit or investigation responses
  • Dispute resolution

11.4 Data Accuracy

You are responsible for:

  • Entering accurate employee information
  • Using correct tax codes
  • Inputting accurate hours and rates
  • Keeping employee records up-to-date
  • Backing up your data regularly

12. Service Availability and Modifications

12.1 Service Availability

We strive to provide reliable service, but we do not guarantee that:

  • The Services will be available 24/7 without interruption
  • The Services will be error-free or bug-free
  • Defects will be corrected immediately
  • The Services will meet all your specific requirements

12.2 Maintenance and Downtime

  • We may perform scheduled maintenance that temporarily interrupts service
  • We will attempt to provide advance notice of planned downtime
  • Emergency maintenance may occur without notice
  • No refunds or credits for service downtime

12.3 Service Modifications

We reserve the right to:

  • Modify, suspend, or discontinue any feature at any time
  • Update the Services without notice
  • Change pricing with 30 days’ notice
  • Add or remove integrations with third-party services

13. Data Ownership and Export

13.1 Your Data

You retain ownership of all data you input into Go Casual. We claim no ownership rights to your:

  • Employee information
  • Payroll records
  • Business information
  • Uploaded documents

13.2 Data Export

You can export your data at any time:

  • Download payroll reports as Excel/CSV files
  • Export employee records
  • Download payslips and documents
  • Request a full data export by contacting support

13.3 Data After Cancellation

After canceling your subscription:

  • You have 30 days to export your data
  • After 30 days, your account may be deleted
  • We may retain data for 7 years to comply with NZ record-keeping laws
  • Retained data is used only for legal compliance, not for marketing

14. Indemnification

You agree to indemnify, defend, and hold harmless Go Casual, Revibe Digital, and their officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any laws or regulations
  • Employment disputes with your employees
  • IRD audits, penalties, or fines
  • Incorrect payroll calculations or payments
  • Any data you provide or upload to the Services

15. Confidentiality

We will keep your confidential information secure, but you acknowledge that:

  • No system is completely secure from data breaches
  • We implement reasonable security measures (see Privacy Policy)
  • You should not store extremely sensitive information beyond what’s necessary for payroll
  • We may be required to disclose information in response to legal requests

16. Third-Party Services and Integrations

Go Casual may integrate with third-party services (e.g., ClickUp for timesheets). We are not responsible for:

  • The availability or functionality of third-party services
  • Data security practices of third-party providers
  • Changes or discontinuation of third-party integrations
  • Errors or issues caused by third-party services

Your use of third-party services is governed by their own terms and privacy policies.

17. User Content and Conduct

17.1 User Content

You are solely responsible for any content you upload, including:

  • Employment contracts and documents
  • Employee photos or identification
  • Company branding and logos
  • Notes and comments

17.2 Prohibited Content

You may not upload content that:

  • Violates any laws or regulations
  • Infringes on intellectual property rights
  • Contains malware or harmful code
  • Is obscene, offensive, or discriminatory
  • Violates employee privacy rights

18. Governing Law and Dispute Resolution

18.1 Governing Law

These Terms are governed by the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the courts of New Zealand.

18.2 Dispute Resolution

Before pursuing legal action, you agree to:

  2. Provide a detailed description of the dispute
  3. Give us 30 days to attempt to resolve the matter

19. Updates to Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Displaying a notice in the application

Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Go Casual regarding the Services and supersede all prior agreements and understandings.
